Terms of Service & Rental Agreement
Last updated: August 2026
1. Agreement to these terms
These Terms of Service and Rental Agreement (the "Terms") govern your use of trygearup.com and any rental of equipment from Gear Up ("Gear Up", "we", "us"). By clicking "Purchase" or "Confirm rental" at checkout, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree to these Terms, do not complete a rental.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to rent equipment. You may be asked to present a government-issued photo ID matching the name on the order at pickup.
3. Rental periods and pricing
Rentals are offered as flat-rate terms: a "Weekend" (Friday afternoon through Sunday evening, three days) or a "Full week" (seven consecutive days). Prices shown at checkout are in U.S. dollars and exclude any applicable taxes, which are calculated and displayed before purchase.
Late returns may be charged an additional rental term at the published rate. If you need more time, contact us before your return date and we will extend the rental when the equipment is available.
4. Payment
Payment is due in full at the time of booking. By clicking "Purchase", you authorize us and our payment processor to charge your selected payment method for the total shown, including taxes and any fees you have agreed to.
Payments are processed by a third-party payment provider. Gear Up does not store your full card details.
5. Cancellations and refunds
Cancel more than 72 hours before your rental start date for a full refund. Cancellations within 72 hours receive a 50% refund or full credit toward a future rental, at your choice. No-shows and cancellations after pickup are non-refundable.
If we cannot supply the equipment you reserved, we will offer a comparable substitute or a full refund.
6. Condition, use and care
Equipment is inspected, cleaned and function-tested before every rental. Inspect it at pickup and tell us immediately about any issue.
You agree to use equipment only for its intended recreational purpose, to follow all instructions provided with it (including fuel, stove and battery safety instructions), and not to sublet, sell or modify it.
7. Damage, loss and theft
Normal wear and tear is expected and is not charged to you. You are responsible for loss, theft, or damage caused by misuse, negligence, or failure to follow provided instructions, up to the replacement cost of the affected item.
We will contact you to discuss any proposed charge before it is applied.
8. Assumption of risk and release
Camping and outdoor recreation involve inherent risks, including risk of serious injury or death from weather, terrain, wildlife, fire, fuel, water, and equipment failure. You voluntarily assume those risks for yourself and any minors or guests in your party.
To the maximum extent permitted by law, you release Gear Up from liability for injury, loss or damage arising from your use of rented equipment, except where caused by our gross negligence or willful misconduct.
9. Limitation of liability
To the maximum extent permitted by law, Gear Up's total liability arising out of any rental or use of this site shall not exceed the amount you paid for the rental in question. We are not liable for indirect, incidental, special or consequential damages, including trip costs, lost reservations, or lost wages.
10. Website content
Campsite guides and gear explainers on this site are provided for general information only. Conditions, regulations, fire restrictions and reservation systems change; verify current information with the managing land agency before you travel.
11. Changes to these Terms
We may update these Terms from time to time. The version in effect when you complete a rental governs that rental. Continued use of the site after an update constitutes acceptance of the updated Terms.
12. Governing law and contact
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Questions about these Terms can be sent to trygearup@gmail.com.
